An Exeter couple who were due in court today for refusing to pay a fine for taking their children out of school in term-time have had their case postponed.
Emma and Joe Clarke, from Broadfields, were fined after they took their primary school aged boys out of school for a holiday last September.
Earlier this month a High Court in London found a father had no case to answer because his daughter had good overall attendance, so our education authority claim the law is now unclear.
Mr and Mrs Clarke were told yesterday that they would have to wait to see if their case will go ahead at Exeter Magistrates Court.
Devon County Council says until a new law is published, it won't know whether schools under its control will fine parents in future.
